Ms Hemi has admitted the breach. We thus find the breach is proved.

Ms Hemi is suspended for 5 days. The suspension commences after racing on 25 April and concludes on 2 May.
Facts:
Mr Davidson alleged that Ms Hemi (TAP TAP) permitted her mount in race 2, the SOUTH PACIFIC MEATS FAIRFAX HANDICAP, to shift inwards passing the 200 metres causing CLASSIC WARRIOR (L Callaway) to be checked.
Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that Ms Hemi was racing 3 out from the rail and, just before the 200 metres, she shifted in causing Mr Callaway, who was racing to her inside, to be checked. Mr McLaughlin demonstrated that she used the stick twice at this time.
Ms Hemi acknowledged her horse had shifted in. She said she had been following the line of Ms Wynne who had shifted ground also, but she agreed Ms Wynne was clear, whereas she was not. She believed Mr Callaway was “going backwards” at the time, although she accepted that he had had to sit up in his irons. She elaborated by saying that her mount was going quicker than that of Mr Callaway and agreed that she was not her length and another clear when she shifted inwards.

Mr Davidson said Ms Hemi had a very good record with just one suspension in the past year, which was at Ellerslie on 16 February. She had been suspended for 7 days for crowding horses to her inside at the 1800 metres. He believed today’s breach was low end.
Ms Hemi agreed that the breach was low end and asked for a deferment until after 25 April, as she had rides on that day. Mr Davidson stated he had no objection to this.

Ms Hemi has shifted in near the 200 metres, when urging her mount with the whip, and has caused a check to Mr Callaway. Their mounts were midfield at the time and neither finished in the placings.
