We find the breach proved. 

Penalty:

We impose a fine of $200 and remind Mr Gray of his obligations under the Rules. 

Charge:

Mr Allison, stipendiary steward, alleged that Mr Gray (JACCKA CREEK) started from his incorrect barrier position. 

Facts:

JACCKA CREEK, which had drawn 1 on the unruly mark started close to the inside of the track rather than towards the outside and beside the horse that had drawn 2 on the unruly mark. 

Reasons for Decision:

Mr Gray admitted the breach.  

Submissions for Penalty:

Mr Allison stated Mr Gray was fortunate that the outcome of the protest was that there was no relegation. He said the breach could be viewed as low end.

He produced Mr Gray’s record, which was clear. He said the respondent should be given credit for this and added that Mr Gray had had very few drives in the last 12 months. He asked us to take into account the respondent’s personal circumstances and submitted a penalty of $200 was appropriate.

Mr Gray accepted Mr Allison’s submissions.

We are satisfied that the breach is low end and can be dealt with by way of a fine.

Mr Gray has only had 3 drives in the past 12 months and states he was not familiar with the rule. We have emphasised to him that he needs to be acquainted with the Rules no matter how frequently he may drive.

We take into account his personal circumstances, his clear record, and his admission of the breach and reduce the fine from a $400 starting point accordingly.
