Manawatu Racing 12 February 2011 – R 2
ID: JCA16070
Code:
Thoroughbred
Meet Title:
Manawatu RC - 12 February 2011
Meet Chair:
TCastles
Meet Committee Member 1:
CMcKay
Race Date:
2011/02/12
Race Number:
R2
Decision:
As the breach was admitted we find the charge proved.
Penalty:
Taking these points into account, this committee has decided to suspend you from race riding after the completion of racing today until the completion of racing on Friday the 18th of February, three national days.
Charge:
Alledged breach of rule 638 (1) (d)
Facts:
Submissions for Decision:
Mr. Goodwin using the available films took the committee through the alledged incident. He informed the committee that Mr. Riddell angled his mount inwards and in coming across forced Miss Johnson to take hold of her mount which was checked.
He called as a witness Miss Johnson who, under questioning from Mr. Goodwin, confirmed that the pressure on her mount came from the outside and was caused by Mr. Riddell's inward movement. She added that she did have to take hold of her mount but did confirm her mount was not travelling all that kindly and she was also attempting to go forward. She felt that Mr. Riddell was only one length possibly 1 ½ lengths clear when he came across.
Mr. Riddell asked Miss Johnson if her horse was racing most ungenerously, to which she agreed.
Mr. Riddell using the available films confirmed that he did come across as did most other runners in the race looking for a run down on the inside. He felt he didn’t cause the problem he was only attempting to put his mount into the race. While agreeing that Miss Johnson did have to take hold, he felt the incident was minor and her mount was travelling ungenerously.
The hearing was then adjourned for the next race.
Upon reconvening, Mr. Goodwin informed the committee that Mr. Riddell wished to change his plea – this was accepted by the committee and the change signed on the information sheet.
Submissions for Penalty:
Mr. Goodwin informed the committee that Mr. Riddell had been charged and suspended under this rule at Waipukurau on the 5th of January. He served a total of 8 days suspension for two charges. Prior to this he was last charged on the 25th of March 2010.
He told the committee Mr. Riddell was a national rider with a busy schedule. Mr. Goodwin believed the incident could be classed in the mid to low range. It did not affect the outcome of the race.
Mr. Riddell had no comment.
Reasons for Penalty:
In coming to our decision to impose a period of suspension for this breach, we have started from a base of 5 days.
We are of the opinion and agree with Mr. Goodwin that the incident is in the mid to low range.
We do have sympathy with your argument that you were not the only rider that came across but as you agreed under questioning you did cause interference to Miss Johnson's mount albeit slight.
As you are classed as a national rider, your record under this rule barring in Mr. Goodwin’s words, a bad day at Waipukurau, is good and we believe this should be reflected in the penalty imposed.
We have also taken into account that you did, midway through the hearing, change your plea to one of admittance.
