Miss Jonker admitted the charge and it is found proved.

Penalty:

Miss Jonker is suspended from the completion of racing on the 29th of November up to and including the 8th of December (4 National riding days).

Facts:

Miss Jonker was charged with a breach or r 638 (1) (d) – careless riding – in that she allowed her mount QUELLA RAGAZZA to shift outwards causing crowding to HOMBRE shortly after the start in Race 3.

Miss Jonker admitted the breach and appeared at the hearing.

Mr Oatham, with the use of the head on video replay, stated that Miss Jonker’s mount QUELLA RAGAZZA jumped sideways on leaving the gate at the start.  However, Miss Jonker failed to correct her mount's inwards movement and continued to shift inwards crowding HOMBRE and causing its Jockey Mr Johnson to check his mount. He said Stewards were not concerned with QUELLA RAGAZZA shifting inwards after the jump, but that Miss Jonker made no attempt to straighten her mount and continued to shift inwards resulting in the crowding to HOMBRE.

Miss Jonker stated that her mount jumped awkwardly from the gate and she was unaware there was crowding to her inside. She thought she was clear of any runners.

Submissions for Penalty:

Mr Davidson stated that Miss Jonker had an excellent record with no charges or warnings in the last 12 months. She had had 74 rides in that time. Stewards viewed the interference at the low end of the scale and sought a suspension of five days.

Miss Jonker said she had confirmed rides on the second day of the meeting and did not seek a deferment of penalty. 

Reasons for Penalty:

The crowding after the start was low end and a starting point of five days appropriate. Miss Jonker has an excellent record over the last 12 months and gets credit of one day.
