As Mr Fannin admitted the breach we find the charge proved.
Penalty:
Accordingly, we impose a suspension on Mr Fannin which will commence after racing on 20 September and conclude after racing on 29 September 2013, this represents the remaining race available for Amateur Riders this season (1 day and in addition impose a $100 fine).
Charge:
Following race 6, Burton Construction Ltd – Flair Amateur Riders Series an information was filed pursuant to Rule 638(3)(b). The Informant, Mr Coles, alleged that Mr Fannin used his whip unnecessary when riding ANYTHING GOES.
Mr Fannin acknowledged that he understood the Rule and the nature of the charge.
Rule 638(3) (b) states: A Rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper.
Facts:
Mr Coles demonstrated on the video films that Mr Fannin used his whip unnecessarily when striking his mount ANYTHING GOES when it was out of contention and not making any ground. He pointed out that Mr Fannin continued to use his whip for every second stride over the final 400 metres of the race.
Mr Fannin informed the Committee that he had not ridden on a heavy track previously and admitted he was not aware how far in front the other horses were. He added that he had previously been instructed to ride his mounts out to the finish line.
Submissions for Penalty:
Mr Coles produced Mr Fannin's record which showed he had a clear record under this Rule. He submitted a fine of $200 would be appropriate.
Mr Fannin submitted that he would prefer a suspension as opposed to a fine due to his financial circumstances. He advised us that he has ridden in 6 races this season.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Fannin's admission of the breach and his clear record. The aggravating facts are his use of whip was unnecessary and we assessed this in the upper mid range and the severity is also assessed as upper mid range. I expressed our concerns to Mr Fannin that it was an extremely poor look when he continued to strike his mount when it was clearly out of contention, not responding to the whip and losing ground.
The Committee did have regard for Mr Fannin's limited opportunities and the fact he is an Amateur Rider.
We referred to similar breaches for unnecessary whip use which showed fines ranged from $200 to $300.
After taking into account all the above factors we consider an appropriate penalty is a 1 day suspension and in addition a $100 fine.
