Facts:

Following the running of Race 1, Teltrac Premier, an information was filed by Chief Stipendiary Steward, Mr J P Oatham, against Licensed Jockey (Class A), Ms S L Wynne, alleging that Ms Wynne, as the rider of SEVERINE in the race, “permitted her mount to shift outwards when not sufficiently clear of SHANPARK (R T Elliot) which was checked near the 250 metres.

Ms Wynne was present at the hearing of the information and she indicated that she admitted the breach.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

   (d) careless.

Mr Davidson, Stipendiary Steward, had Manager of Stewards, Mr N G McIntyre, show video replays of the incident on the available video replays.

He pointed out the two runners – SEVERINE, ridden by Ms Wynne and SHANPARK (R T Elliot). Approaching the 250 metres, Ms Wynne’s mount was racing behind and to the inside of DECEPTIO VISUS (J D Laking), which had taken the lead, with SHANPARK on her inner. Ms Wynne then attempted to shift off the back of the leader into the path of SHANPARK, forcing Mr Elliot to take a hold of that horse. Mr Davidson said that, at the time, Ms Wynne’s mount was barely 1¼ lengths clear, probably only 1 length.

Ms Wynne said that she had to try to make her move gradually to clear Mr Laking’s mount’s heels. She heard Mr Elliot shout to her but she had completed her move by then. Had she heard him a stride earlier, she said, it would have been “totally different”.

Submissions for Penalty:

Mr Davidson told the Committee that Ms Wynne has two recent suspensions on her record – at South Canterbury on 11 October 2019 (suspended 7 days) and on 13 November 2019 (suspended 8 days). That latter suspension expires on 29 November 2019, Mr Davidson said.

The present breach is in the low-to-mid range, Mr Davidson submitted. He said that Ms Wynne’s record was viewed as neutral and she had admitted the charge. A 6-7 days suspension would be appropriate, he submitted.

Ms Wynne said that she had recently resumed race riding after 16 months away through injury. She has probably been trying too hard, she said. She admits that she has a lot to work on. She needs to “polish up” on her “judgement skills”, she said.

Reasons for Penalty:

The Committee has assessed the degree of carelessness as being in the low-to-mid range, as submitted by Mr Davidson and we have adopted the Penalty Guide starting point of 7 national riding days in this case. The Committee did not agree with Mr Davidson’s assessment of Ms Wynne’s record as being a neutral factor. This breach is, in fact, her third breach in 5 weeks. We have treated her record as an aggravating factor and, for that, we have uplifted the starting point to 8 national riding days. However, Ms Wynne is entitled to a discount, which we fix at 1 day, for her admission of the breach.
