Apprentice Jockey Miss M Vance was charged with a breach of Rule 605(1) in that she failed to present herself in the jockeys room by the required time and was replaced on San Cabo.
Facts:
Rule 605(1) states ' A rider who has a riding engagement at a race meeting must present himself in the jockey's room at least 40 minutes before the starting time for the first race in which he has a riding engagement'
Mr Coles told the committee that he was advised by trainer Mr C McNab just prior prior to the start of the first race that Miss Vance assigned to ride San Cabo in race two was not going to arrive in time. She duly arrived arrived 15 to 20 minutes before the start of the race but had been replaced on the favourite by jockey D Johnson.
Miss Vance said she had not left time for error when leaving for the races and found her car battery flat.
Arrangements were made for a replacement rider and Miss Vance was spoken to on her arrival.
She told the Stipendiary Stewards that she had trouble in locating assistance to start her car but having done so drove directly to the track.
Miss Vance confirmed to the committee that she had taken advice from her employer Mr McNab before admitting the charge.

Mr Coles told the committee that Miss Vance had no previous breaches of the Rule and in line with previous penalties and the Jca guidelines submitted a minimum fine of $100 should apply.

Her delay in presenting herself on track caused some disruption to her employer and meant the favourite runner required a replacement rider because Miss Vance failed to allow sufficient time for unforeseen circumstances.
