Decision:

As Mr Chowdhoory admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Mr Chowdhoory suspension pursuant to Rule 1106(2).

Accordingly, Mr Chowdhoory had his license to ride in races suspended for a period to commence after racing on 29 April and conclude after racing on 10 May 2018 (7 days).

The 29 April race meeting at Blenheim was not included in the penalty because the declaration of riders had closed.

Facts:

Following the running of race 7, the West Brook Wines 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Chowdhoory angled his mount (ARTIC STORM) out when insufficiently clear passing the 300 metres, crowding O’HE CAN which was checked and then continued to shift out when not fully clear of WHENHARRYMETSADDLE which was hampered and became unbalanced.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Chowdhoory acknowledged that he understood the Rule and confirmed that he admitted the breach. He was assisted at the hearing by Mr Harris.

Using the available video footage, Mr Jones demonstrated the incident. He identified that at the 300 metre mark Mr Chowdhoory was being held up for a run. As a result he angled his mount outward when not clear of O’HE CAN which was checked. He said that Mr Chowdhoory continued to shift out and in doing so he hampered the progress of WHENHARRYMETSADDLE who became unbalanced. He added that Mr Chowdhoory was never any more than ¾ to 1- lengths clear of horses to his outer when he made the shift.

Mr Chowdhoory advised the Committee that at the 300 metre mark he was held up for a run and angled out without taking due care. He said that he viewed the race films in the presence of his employer, Mr R Collett and they accepted the charge was appropriate and he will treat the matter as a learning experience.

Mr Harris advised that Mr Chowdhoory is an inexperienced apprentice rider. He said that he is a keen student who will take some benefit out of the incident.

Submissions for Penalty:

Mr Williamson advised the Committee that this was Mr Chowdhoory’s 5th race day ride, he is clearly an inexperienced rider and asked the Committee to take into account his inexperience when assessing penalty.

Mr Williamson said that Mr Chowdhoory was barely 1 length clear when he shifted out and given that at least 2 horses were affected the level of carelessness was mid-range.

Mr Chowdhoory advised that he has a confirmed engagement for the Cambridge meeting on 28 April 2018 and sought a deferment of any proposed suspension until after that date. In his submission as to penalty Mr Harris reaffirmed that Mr Chowdhoory is an inexperienced apprentice rider who will learn a great deal from the incident. He said that Mr Chowdhoory needs to be patient and had he waited it is likely that a run would have eventually presented for ARTIC STORM. 

Reasons for Penalty:

In determining penalty the Committee carefully considered all the evidence and submissions presented. The video evidence is clear in that Mr Chowdhoory whilst being held up for a run, may have panicked and shifted out when not clear of runners to his outer. In addition to O’HE CAN and WHENHARRYMETSADDLE being checked and hampered, other horses racing in close proximity were also affected to a limited degree. It was also of note to the Committee that Mr Chowdhoory permitted his mount to shift out at least 3 to 4 horse widths.

The Committee deemed the level of carelessness as mid range and adopted 8 national riding days as the starting point. The mitigating factors were Mr Chowdhoory’s admission of the breach and his inexperience for which we afforded him a 1 day penalty discount. Mr Chowdhoory did allow his mount to continue to shift out and continue to ride forward after the first check to O’HE CAN. We consider this to be an aggravating factor, but we are mindful that this was his 5th race day ride and we are confident with guidance and tutelage from both Mr Collett and Mr Harris, Mr Chowdhoory will learn a great deal from the experience. After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
