The protest is upheld and THE BUCKET LIST is disqualified from the race pursuant to Rule 1003(2) (a).
The amended placings are now:

It was ordered that dividends and stakes be paid in accordance with the amended placings.
Facts:
Following the running of Race 3, Lot 104 Razor Brodgen Mobile Pace, an Information was lodged by Stipendiary Steward, Mr J Muirhead against the 2nd placing of THE BUCKET LIST (Z Butcher) on the grounds of galloping excessively (the last 100 metres) in breach of the Breaking Horse Regulations.
Rule 870(3) provides: "that any horse that breaks from its gait shall be promptly returned to its gait."
The Breaking Horse Regulations (part B) provides: "any horse which breaks from its gait in the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait."
The Regulation further provides: "where a protest has been duly lodged against the placing of an offending horse, The Judicial Committee shall either: (1) relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained; or (2) disqualify it from the race under Rule 1003(2)."
Mr R Lawson was present at the hearing and confirmed that he represented the connections of THE BUCKET LIST. Mr Lawson on behalf of Mr Small endorsed the Information “I do not contest the protest”

Mr Muirhead demonstrated the incident by use of the video films. He showed THE BUCKET LIST broke passing the 100 metres mark failing to regain its gait.
Mr Muirhead submitted THE BUCKET LIST be disqualified from the race.
Reasons for Decision:
The Committee took into account the evidence of Mr Muirhead and note that Mr Lawson did not contest the protest. The video clearly shows THE BUCKET LIST galloped for the final 100 metres of the race and has therefore breached the Breaking Horse Regulations.
