Mr Campbell admitted the breach and it is found proved.

Facts:

Following the running of race 7 the Forde Auto Services & Go Fuel Handicap stewards charged Mr C Campbell (Jackfrost) with a breach of excessive use of the whip in that he “…used his whip in an excessive manner prior to the 100m.”

Rule 638 (3) (b) (ii) reads: A Rider shall not:

(b) strike a horse with a whip in a manner or to an extent which is:

(i) unnecessary (ii) or excessive (iii) or improper

The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.

Mr Campbell admitted the breach and appeared at the hearing assisted by Mr Walsh.

Mr McLaughlin, with the aid of the videos, stated Mr Campbell, in the home straight, struck his mount about nine times prior to the 100 metre mark. He had not stopped the use of the whip for the required five stride break. Mr Tidmarsh stated Mr Campbell continued to strike his horse over a distance without enough respite.

Mr Walsh stated it was a clear breach of the guidelines and the rule. He said Mr Campbell needed to work on his whip action to help him break it up. Mr Campbell accepted the evidence of the stewards.

Submissions for Penalty:

Mr Tidmarsh stated Mr Campbell had ridden 197 times this season to date. It was his first full season as an apprentice jockey. He had 39 rides last season. Mr Campbell had breached this rule on the first day of the meeting and this was his second breach. The JCA Penalty Guide recommended a fine of $500.

Neither Mr Campbell nor Mr Walsh made any specific submissions as to penalty.
