As Ms McCall admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a deferment to Ms McCall’s suspension pursuant to Rule 1106(2).
Accordingly, Ms McCall had her license to ride in races suspended for a period to commence after racing on 23 June and conclude after racing on 29 June 2019.
Facts:
Following the running of race 1, Waipa Home of Champions 1150, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that near the 800 metres Ms McCall permitted her mount SLEEPY GEEG to shift in when insufficiently clear of NU ROUGE which was checked losing ground.
Ms McCall said that she understood the Rule and confirmed her admission of the breach.
Mr Harris assisted Ms McCall at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson demonstrated the incident using the available video footage. He identified that near the 800 metres SLEEPY GEEG was racing in a 4 to 5 wide position and to her inside was NU ROUGE (S Spratt). He said Ms McCall shifted her mount inwards which crowded and checked NU ROUGUE. As a consequence that runner lost about 1 ½ lengths. He added that the inward shift was not a sudden movement and stated it was an error of judgement by Ms McCall.
Ms McCall said that she heard Ms Spratt “call out” but by that stage she had commenced to shift inwards. She added that her mount was a big striding horse and an awkward ride. In conclusion Ms McCall accepted that she did not make enough effort to correct her mount.
Mr Harris said that the track is tight turning and even senior riders experience difficulty in negotiating the bends.
Submissions for Penalty:
Mr Coles said that Ms McCall had no previous careless riding breaches on record. He said that SLEEPY GEEG's racing manners were a contributing factor and the Stewards assessed the breach to be low end and a suspension in line with that would be appropriate.
Ms McCall advised the Committee that she had engagements up to and including the 23rd of June and therefore sought a 7 day deferment to her proposed suspension.
Mr Harris asked for leniency given Ms McCall’s clear record and admission of the breach.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
When reviewing the video footage the Committee observed that Ms McCall allowed her mount to shift in near the 800 metres when insufficiently clear of NU ROGUE. As a result that runner was crowded and checked losing about 2 lengths.
The Committee deemed the level of carelessness displayed by Ms McCall was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which we adopted.
There were no aggravating factors that warranted an uplift in penalty.
The mitigating factors were Ms McCall’s admission of the breach and her unblemished record. For these collective factors Ms McCall was afforded a 2 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 4 days.
