Mr Allison alleged that the 3rd placed horse ROWCHESTER broke in excess of 50 metres during the final 200 metres of the race.

Submissions for Decision:
Mr Allison, stipendiary steward, demonstrated on the video that ROWCHESTER broke for over 100 metres, commencing before the 100 metre mark, when the horse attempted to make a run in the passing lane. The horse continued in a gallop to the winning post.
Mr Dunn, the driver of ROWCHESTER, represented the connections and indicated he did not contest the protest.
Reasons for Decision:
In exercising our discretion under r 1003(2) to disqualify ROWCHESTER we are satisfied that the horse broke for over 100 metres in the final stages of the race. In accordance with para (b) of the breaking horses regulations ROWCHESTER is deemed to be in breach of r 870(3) in that the horse has failed to promptly regain its proper gait.
