As Mr Beeharry has admitted the breach, we find the breach proved.

Penalty:

Mr Beeharry is suspended after racing on 2 April up to and including 13 April. This is eight National days.

Facts:

Following the running of Race 5, the ELMWOOD CATERING POURAKINO HANDICAP, an information was filed by Stipendiary Steward, Mr Davidson, against, Mr Beeharry, alleging careless riding in that he allowed his mount FRIDAY KNIGHT to shift outwards near the 150 metres crowding and checking ROCK SOLID, which in turn was forced into the line of WILD JACK.

Mr McLaughlin demonstrated that Mr Beeharry was the leading horse into the straight. His horse drifted out and he straightened the horse, which then shifted in a little before then shifting out three to four horse widths when being hit with the stick.

Mr Walsh agreed that Mr Beeharry had first gone out, straightened, and had then run out again. He said with the heavy ground and Mr Beeharry’s horse being new to staying races, it had tired and had run around. He accepted the onus was on the jockey to straighten his horse but asked us to take into account track conditions.

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which evidenced two previous breaches of this rule: one on 8 December and another on 22 December 2017. He believed this record should be viewed as neutral, as Mr Beeharry had had three months clear. He stated Mr Beeharry was apprenticed to Mr Tapper and rode mostly in the south of the South Island. He described the breach as mid to high range.

Mr Walsh said the breach was mid range at worst. He said whilst there was a lot of sideways movement, other riders had not had to take hold.

Mr Beeharry asked for the suspension to start after the second day of the meeting.

Reasons for Penalty:

We are satisfied that Mr Beeharry has moved some four horse widths wider on the track. He continued to ride the horse out at this time. In his favour, is the fact that when the horse first commenced to shift, he took corrective action. However, he then failed to comply with his obligations under the rules. Mr Walsh is correct when he says Mr Beeharry shifted out some distance. We do not accept that no other horses were affected. Mr Mudhoo had to take a strong hold of ROCK SOLID. That horse lost momentum and finished on again for fifth, only a nose from fourth.

We believe the breach is at the higher end of mid range and take a 9-day starting point. We do not uplift for record and give a one day deduction for admission of the breach.
