Facts:
Mr Wallis, alleged that in race 3, SUNNYANDCHER, placed 3rd by the Judge, broke from its gait over the finish line and was lapped on by ROYAL PILOT. He sought relegation of SUNNYANDCHER from 3rd to 4th.

The margin between 3rd and 4th was a neck, with a further 1 L ¼ back to the 5th horse.

Mr Wallis read R 870(5) and demonstrated by reference to the video that SUNNYANDCHER lost its gait just prior to the winning post. The horse was lapped on by ROYAL PILOT when it galloped across the line. There was no suggestion that SUNNYANDCHER had galloped as a result of receiving interference. Mr Orange, the driver of SUNNYANDCHER, indicated on the information that he concurred with the Stipendiary Steward’s analysis of the videos and he did not contest the protest.
Reasons for Decision:
We find that SUNNYANDCHER was in a gallop when it crossed the finishing line and was lapped on by ROYAL PILOT.
