As Miss Frye has admitted the charge the breach is proved.

Penalty:

Miss Frye is suspended from the conclusion of Reefton on January 8th, up to and including January 12th (Kumara and Foxton).

Facts:

Following the running of race 6 the AWS LEGAL ALEXANDRA 65 Stipendiary Steward Mr M Davidson lodged an information alleging Miss A Frye (WESTERN HANOVER) shifted ground outwards approaching the 100 metres resulting in NO MEAN FEAT (Mr J Wong) being checked.
Miss Frye admitted the charge and appeared at the hearing assisted by Mr Frye.

Rule 638(1) provides: “A Rider shall not ride a horse in a manner which the Judicial Committee considers to be … (d) careless”.

Mr Renault demonstrated on the videos the relevant positions of both Miss Frye (Western Hanover) and Mr Wong (No Mean Feat) from about the 250 metres mark to the finish line.

Mr Davidson stated Miss Frye was approximately 3 horse widths off the running rail and began shifting outwards to about centre track. Approaching the 100 metres Miss Frye continued the outwards movement causing Mr Wong to check his mount and switch his line to the inside of Western Hanover.

Miss Frye stated she had shifted wide to gain better going for her mount. She thought Mr Wong’s mount was further back than it was and also thought she was clear of him when she crossed over. Mr Frye stated he was in two minds whether to scratch the horse due to the day’s track conditions. He said Miss Frye had shifted outwards but in doing so her line had been dictated by the leading horses OUR SANTANA and IMA GEEGEE, which had also rolled outwards in front of her. He said WESTERN HANOVER had overreacted when being angled out and had gone wider than he needed to.

Mr Davidson said Miss Frye was a very busy apprentice who rode in both the South Island and the Central Districts. Miss Frye had good record but had a previous suspension from Ashburton in October. She had over 500 rides with 200 of these this season. He viewed the incident at the low end of the scale. Miss Frye had made a misjudgment and had not been aware of the runner on her inside. He was seeking a suspension of 2/3 days.

Miss Frye stated she was committed to Greymouth on January 4th. She asked for any suspension to be deferred until after Reefton on January 8th.

Reasons for Penalty:

The committee is satisfied the level of interference was at the lower end of the scale. Miss Frye was given credit for her early admission of the breach, her good riding record and her cooperation with the Stewards. We also took into account that Miss Frye is riding in the Central Districts. In this instance a suspension of 2 days is appropriate.
