As the breach was admitted we find the charge proved.

Accordingly after taking all the above facts into account and under the provisions of rule 1106(2) we impose a suspension on Mr Cropp from riding in races which is to start after racing on 9 April and conclude after racing on 14 April 2012 (4 days).

Before the hearing started Mr M Cropp confirmed he was still an apprentice but did not seek to have representation.
Following race 2 an information was filed pursuant to rule 638(1)(d). Mr J Oatham alleged that Mr Cropp permitted his mount HOBO to shift outwards near the 250 metres when not sufficiently clear crowding LUHSING (Mr C Ormsby) causing it to blunder.
Submissions for Decision:
Mr Tidmarsh demonstrated the video films pointing out to the committee HOBO ridden by Mr Cropp racing in a 3 wide position approaching the 250 metres. It was evident soon after this that Mr Cropp shifted out 1 - 2 horse widths when only a bare length clear of LUHSING (C Ormsby). Mr Tidmarsh said Mr Ormsby received quite a severe check and could easily have fallen.
Mr Cropp had nothing to say when asked.
Submissions for Penalty:
Mr Oatham said Mr Cropp had only incurred one suspension in the last 12 months. He submitted there were some mitigating factors including the muddy state of the ground which impaired Mr Ormsby's vision. However he said Mr Ormsby received quite a severe check and submitted Mr Cropp's carelessness was in the mid range.
Mr Cropp said he had commitments up to and including 9 April.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In Mr Cropp's favour are his admission of the breach and his good record. Another mitigating factor considered was the muddy state of the track which affected Mr Ormsby's vision. However Mr Cropp did not attempt to straighten his mount when moving out which caused the sharp check to Mr Ormsby. The committee finds his carelessness to be in the low to mid range.
