The charge having been admitted is accordingly proved.

Penalty:

The Committee accordingly imposes a fine of $200.00 on the M Purdon and G Payne Partnership.

Charge:

Breach of Rule 865(2) – Gear Notification

Facts:

Following the running of Race 6 an Information was lodged by Stipendiary Steward Mr BJ Van Kan against the Training Partnership of M Purdon and G Payne alleging a breach of Rule 865(2) in that they presented BETTOR PARTY to race without the notified half blinds.

Mr J Young the Northern Foreman for the Purdon/Payne Partnership was present at the Hearing and advised this Committee that he did admit the breach.

Rule 865(2) provides:

“Every horse entered in a totalisator race shall be presented in the Assembly Area prior to the race in the same notifiable gear as that notified under Sub-Rule (1)”.

Mr Van Kan advised the Committee that the notified gear for BETTOR PARTY was that it would be wearing half blinds. He said that it was presented in the Assembly Area without half blinds.

Mr Young for his part said that the horse had arrived up to join the northern stable at the start of the week. It had been sent up with an open bridle and it had recently won easily at the trials down South wearing an open bridle. He said he relied on this when gearing up the horse and he had not been told otherwise.

When asked by the Chairman he said that he had not checked the HRNZ website but would do so in the future.

Submissions for Penalty:

Mr Van Kan said that this matter was brought to the JCA Committee because of the number of previous breaches by the Purdon/Payne Partnership. He did say that although the horse was presented in the Assembly Area without the notified half blinds, he had noticed this and had drawn it to Mr Young’s attention and the gear was changed so the horse did in fact race with half blinds.

Mr Van Kan submitted that a fine of $200.00 was appropriate.

Mr Young for his part submitted that although the Training Partnership had several other breaches of this Rule, the Partnership raced many horses around the country and that the number of breaches should be considered alongside the number of starters.

Reasons for Penalty:

The Committee considered the evidence and it is aware that the Purdon/Payne Partnership have many starters during the season. The Partnership however does have not only the Trainers but also the Foremen responsible for administration and there have been several breaches of the same Rule this season.

The Committee believes the fine submitted by Mr Van Kan is appropriate.
