Accordingly, the Protest was upheld and ASH was disqualified from 5th place in the race.

The amended placings are now:

1st (10) SUNNY GLENIS
2nd (12) C K SPUR
3rd (9) CREDIT MASTER
4th (7) MR GOOD AND EVIL
5th (3) GALLEONS VICTORY

The Committee ordered that stakes and dividends be paid in accordance with the amended placings.

Facts:

Following the running of race 5, Nautilus Charters Supports Wish 4 Fish Handicap Trot 2700 metres, an Information was filed by Senior Stipendiary Steward, Mr Mulcay. He alleged that ASH placed 5th (by the Judge) galloped in excess of 50 metres inside the final 200 metres.

Rule 870(3) states: any horse that breaks during the running to promptly regain its proper gait.

The Breaking Horses Regulation:

Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

The Trainers endorsed the Information “I do not contest the Protest and do not wish to be present at the hearing.”

Mr Mulcay demonstrated the incident by use of the video films and showed that ASH broke near the 170 metres and galloped a considerable distance before settling near the 30 metres.

Submissions for Decision:

Mr Mulcay submitted that ASH was in breach of Rule 870(3) and therefore it should be disqualified from the race.

Reasons for Decision:

The Committee reviewed the video films and we were satisfied that ASH did break from its proper gate within the final 200 for more than 50 metres which is a clear breach of the Rules. We note the Protest was not contested by the Trainers.
