As Mr Russell admitted the breach the charge was found proved.
Penalty:
Accordingly under the provisions of rule 1106(2) we impose a suspension on Mr Russell which will commence after racing on 2nd November and conclude after racing on the 8th November 2011(4days).
Charge:
Following Race 8 an information was lodged pursuant to rule 638(1)(d). The informant Mr Williamson alleged that passing the 200 metres RED SHIFT (T Russell) when being ridden out shifted in when not clear causing GAULONITIS (J Waddell) to check his mount losing ground.
Facts:
Mr Coles demonstrated the video films which showed at the 250 metres Mr Russell riding RED SHIFT was 4 off the running rail. At this point GAULONITIS ridden by Mr Waddell was racing 2 off the running rail. He pointed out to the committee where Mr Russell's mount slowly shifts in causing crowding to Mr Waddell's mount causing him to take a hold and sit up.
Mr Russell admitted the head on film confirms that he did shift in however he believed Ms Thornton who was racing on the inside of Mr Waddell's mount contributed to the incident when shifting out slightly.

Mr Williamson said Mr Russell had been back riding for 2 months and had a clear record. He said Mr Russell had made an error of judgement and rated the interference to be lower end. He submitted a suspension should be at the low end.
Mr Russell said he had firm committments at Paeroa on November 2nd and would like the suspension to start after that race day.

The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Russell's admission of the breach and his very good record. The aggravating factor is Mr Russell continued to ride forward when his mount was shifting ground. We grant Mr Russell's submission to ride at Paeroa on November 2nd.
