As Miss McIntyre had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Accordingly Miss McIntyre’s Junior Horsewoman’s Licence was suspended from after the completion of racing tonight, the 23 December 2010, until after the completion of racing on 31 December 2010. This amounts to a two day suspension, the relevant race days being 29 December 2010 at Banks Peninsula Trotting Club, and 31 December 2010 at NZMTC.

Charge:

Following the running of Race 6, the Canterbury Trotting Owners Pace, an Information was filed by Stipendiary Steward Mrs K. R. Williams against Junior Horsewoman Miss M. R. McIntyre alleging a breach of Rule 869(2)(a) in that she used her whip excessively.

The charge reads as follows.

“I the above named informant allege that the above named Defendant committed a breach of Rule 869(2)(a) in that M. McIntyre used the whip excessively on Gate Bender in the run home.”

Rule 869(2)(a) reads as follows.

“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”

Facts:

Miss McIntyre had indicated on the Information that this breach of the Rules was admitted, and also that she did not wish to attend the hearing.

Mrs Williams gave evidence and used video coverage to show that “Gate Bender” (8) led into the straight and that Miss McIntyre had used her whip on 19 occasions in the run home.

Submissions for Penalty:

In relation to penalty Mrs Williams advised that Miss McIntyre had admitted this breach, but had a previous conviction under this Rule on 21 March 2010. During discussions with Miss McIntyre she said that she would prefer a suspension to a fine.

Mrs Williams submitted that a two day suspension be imposed in this case.

Reasons for Penalty:

After considering the facts of this matter we were satisfied that a two day suspension should be imposed in this case.
