As Mr Quinn admitted the breach we find the charge proved.

Penalty:

Accordingly, Mr Quinn is fined $150.

Facts:

Following the running of race 2, Waikato Farriers Hurdle, an Information was filed pursuant to Rule 638 (2). The Informant, Mr Coles, alleged that Mr Quinn made a celebratory gesture prior to passing the winning post on his mount BRAVE BUCCANEER.

Mr Quinn acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(2) provides: A Rider shall not make a celebratory gesture prior to his horse passing the winning post.

Mr Oatham demonstrated on the video film that Mr Quinn made a celebratory gesture several strides before the finish line. He described the gesture as exuberant.

Mr Quinn advised that he had ridden the horse all season and admitted he got excited near the finish line. Mr Quinn added he thought he was at the finish line when he made the gesture.

Submissions for Penalty:

Mr Coles said Mr Quinn should be given credit for his early admission of the breach and his clear record under this rule. He submitted a fine of $150 would be an appropriate penalty.

Mr Quinn said he thought the penalty was a bit tough but conceded the rules had to be complied with and noted his gesture was very close to the line.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Quinn’s admission of the breach and his good record in relation to this rule. We assess the breach at the low end of the scale and had regard for the fact Mr Quinn is a Jumps rider.

We referred to previous breaches of this rule for Jump riders before imposing penalty.

After taking into account all the above factors we consider an appropriate penalty is a $150 fine.
