As Mr Webb admitted the breach we find the charge proved.
Penalty:
We grant Mr Webb's request to seek a deferment to his suspension as per rule 1106(2).
Accordingly, we impose a suspension on Mr Webb which will commence after racing on 6 June 2012 and conclude after racing on 16 June 2012 (4 days).
Charge:
Following race 3, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson, alleged that Mr Webb permitted his mount VERDASCO to shift outwards inside the final 100 metres crowding FORTY TWENTY onto DIVINE PROMISE with FORTY TWENTY being checked.
Facts:
Mr Williamson demonstrated the incident by using all the available films. He pointed out to the committee that Mr Webb continued to ride his mount forward with the whip in the final 100 metres. However, in doing so, his mount shifted out and took the rightful running line of 2 runners on his outside.
Mr Webb told the committee that it was self explanatory on the films. He admitted that he had not done enough to correct his mount from shifting out.
Submissions for Penalty:
Mr Williamson produced Mr Webb's record which showed 1 previous breach of this rule in the last 12 months. He submitted that Mr Webb's level of carelessness was mid to low range, noting that FORTY TWENTY received significant interference. He submitted an appropriate penalty was a 4 to 5 day suspension.
Mr Webb told the committee that he had firm commitments at Matamata on 6th June 2012 and was seeking a deferment to his suspension. He informed the committee that he was a highweight and jumps rider only and rode all over the country.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Webb's admission of the breach and his very good record. However, this has to be balanced against the level of carelessness which we assess as low to mid range and the significant check FORTY TWENTY received.
The committee referred to the Thoroughbred Racing monthly publication to establish the appropriate dates in relation to eligible highweight and jumping races.
