Penalty:

Miss. Lloyd you are suspended from race riding after the completion of racing today, the 22nd of June, until the completion of racing on the 7th of July – 4 Central District days being 28th of June at Wairarapa, 30th of June at Hawkes Bay, 3rd of July at Waverley, 7th of July at Manawatu.

Facts:

Miss E. Lloyd admitted a breach of rule 638 (1) (d) in that passing the 1100 metre mark she allowed her mount ‘Antownon’ to shift in when not clear of ‘Logan’ which was checked.

Submissions for Decision:

Mr. Goodwin using the available films indicated the point in the race the incident occurred. Miss Lloyd angled her mount inwards to get a position causing Miss. Allpress, riding ‘Logan’ to take hold. The effect of this also caused problems to one other horse down on the inside.

Miss Lloyd concurred with Mr. Goodwin's submission in that ‘Logan’ was tightened by her actions but did inform the committee that Miss. Allpress did not call.

Submissions for Penalty:

Mr. Goodwin submitted that this was Miss. Lloyd's second charge under this rule since her come back to race riding after an enforced layoff. She had received a 3 day suspension on the 10th of April 2012.

Her come back (she started racing again in October 2011) had so far been moderately successful with 2 winners on one day at Trentham.

He indicated that she rode only in the Central Districts and believed the breach could be defined as moderate, but did ask for a period of suspension. Miss. Lloyd confirmed that she was a Central Districts rider only and that she understood that she could ask for a 7 day determent in the event a penalty of suspension was imposed. She did however confirm that she did not want to take advantage of any determent.

Reasons for Penalty:

Miss. Lloyd in coming to our decision to impose a period of suspension for this breach we have taken into account your admittance of the breach. We have also in the penalty reflected the fact that you ride only in the Central Districts and that you have made a successful return to race riding after an enforced lay off. However, your actions did cause interference to at least one other horse forcing Miss. Allpress’ mount off its rightful line. We used as a starting point a period of suspension of 5 days but believe this is able to be reduced to reflect the mitigating circumstances outlined.
