As a result of our finding the Protests 3rd against 1st and 2nd were upheld.

The placings now read:-
1st - SUPERDONNA, No.10
2nd - EXTORTION, No.15
3rd – CORRETTO, No.5
4th - FLIGHT PLAN, No.19
5th - OUR SASSY CAT, No.13

Authorisation for payment of dividends and prize money on the amended placings was given by the Committee.

Facts:

Following the running of Race 3, (Towers Insurance Brokers 1200) Information A14408 was filed with the Judicial Committee. It was alleged that Horse No.15 EXTORTION (1st) and Horse No.5 CORRETTO (2nd) interfered with the chances of Horse No.20 SUPERDONNA (3rd) in the final straight.

The Judge’s placings were:-
1st - EXTORTION
2nd - CORRETTO
3rd - SUPERDONNA
4th - FLIGHT PLAN
5th - OUR SASSY CAT

The margins between the first three placings were a nose and ½ length.

Part way through the hearing and at the request of the Stipendiary Steward, proceedings were adjourned to allow the Jockeys etc to meet with the Stewards to determine if the Race Meeting was to be abandoned due to a horse falling after reaching the winning post in Race 3.

Submissions for Decision:

Mr Miller, the Trainer of SUPERDONNA, said that his horse received pressure from the outside and inside horses. He said that his horse was stopped in its tracks and was not given a fair go. He added that his horse had maintained a straight line and should have won the race.

Mr McKay, the Rider of SUPERDONNA, said that he came from behind, hit the front and then got squeezed up. He said that he lost all momentum and had to sit up. He said that he would have won by a neck.

Mr Da Cruz, the Trainer of CORRETTO, said that his horse tried to maintain a straight line and that there was slight interference. He said that the winner shifted in when you look at the lines on the track. He added that if the winner (EXTORTION) had not come in on that trajectory it might have been different.
He believed that his horse should have won the race.

Ms Collett, the Rider of EXTORTION (and representing the Connections), said that her horse shifted in and that Mr Yanagida (CORRETTO) shifted out. She said that her horse had shifted in slightly after coming from behind and that the 3rd horse (SUPERDONNA) had a fair run to the 20m. Ms Collett added that the 3rd horse had had its opportunity.

Mr Williamson for the Stipendiary Stewards said that at the 100m SUPERDONNA and EXTORTION were one length behind CORRETTO. Then at the 50m SUPERDONNA AND EXTORTION were challenging for the lead. He said that EXTORTION then shifted in intimidating SUPERDONNA and then CORRETTO shifted out abruptly onto SUPERDONNA who was crowded and checked for approximately 6 strides.

Reasons for Decision:

The Committee took particular cognizance of all submissions and reviewed the film replays several times when considering its decision regarding the Protests 3rd against 1st and 2nd.

We found that inside the final 100m of the Race, EXTORTION who was racing on the outside and in the clear, shifted in onto the rightful running line of SUPERDONNA. Then CORRETTO racing inside of SUPERDONNA shifted out onto SUPERDONNA. The two shifts resulted in SUPERDONNA running out of room, being jostled, losing momentum, with the Rider having to stop riding out and forced to check his mount for the final few strides. Hence the margin being ½ length between 2nd and 3rd.

We noted that Ms Collett continued to ride out to the end of the Race. Prior to interference occurring SUPERDONNA was finishing strongly and when interference did occur she was at the very least sharing the lead.

Although contact was not made between EXTORTION and SUPERDONNA, contact need not occur to constitute interference.

Taking all matters into consideration it was the Committee’s opinion that if such interference had not taken place and that SUPERDONNA had been left with a clear run which was its entitlement, and had been able to have been ridden out fully, it would have won the Race.
