Facts:
At the conclusion of race 1 The Vincent Langford Memorial Chilton Shearing maiden an information A 3871 was lodged by Stipendiary Steward Mr M Davidson alleging that with approximately 1000 metres to run BARTER (S Muniandy) shifted ground inwards when insufficiently clear of MIDNIGHT MOCHA (T Direen).
Rule 638 (1) (d) reads; A rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Stipendiary Steward Mr C Allison showed the committee several video clips of the incident, highlighting the inward movement of BARTER (S Muniandy) moving across from the three wide position into the two wide position when not sufficiently clear of MIDNIGHT MOCHA ridden by Miss T Direen.
Stipendiary Steward Mr M Davidson stated that Mr Muniandy was only 1 ½ lengths clear not the two lengths that are required. Mr Muniandy stated that he had made an error of judgement and although he had looked on a couple of occasions he had moved across too quickly.
Mr Muniandy also believed that Miss Direen’s horse, MIDNIGHT MOCHA had charged forward in response to his horse shifting inwards.
Submissions for Penalty:
Mr Davidson described the incident as at the bottom end of carelessness, and said that Mr Muniandy had miscalculated by a little more than a quarter of a length when moving across.
Mr Davidson stated that Mr Muniandy had two previous breaches under this rule in the past calendar year on January 1st at the Waikouati meeting where he received a 3 day suspension, and at the Hororata meeting on 22 March 2014 where he received a further 3 day suspension.
Mr Davidson submitted a 2 or 3 day suspension was appropriate. Mr Muniandy stated that he had had a quiet winter riding and was starting to gain more opportunities with the spring racing.
He was the senior rider in Otago and worked for a large stable, whose racing team was coming to hand now.
Reasons for Penalty:
We believe the breach is at the lower end of the scale and that Mr Davidson was correct when he stated that it was only a slight error of judgement from Mr Muniandy. It is clear that Mr Muniandy did not shift ground inwards without looking, and we accept that Miss Direen’s horse over raced as a consequence of his horse shifting inwards.
The JCA penalty guide recommends a starting point of a five day suspension. We have given a one day reduction for the low end nature of the breach and a further one day reduction for Mr Muniandy’s early admission.
Because a three day suspension would extend to the Canterbury Premier meeting on the 25 October 2014 and having regard to the precedent in the ’C’ case we have taken this into account when fixing the penalty.
