As Mr Bakar admitted the breach the Committee found the charge proved.
Penalty:
Accordingly, Mr Bakar had his license to ride in races suspended for a period to commence after racing on 19 October and conclude after racing on 2 November 2018.
The declaration of riders had closed for racing on 20 October at Rotorua and 21 October at Otaki therefore those race meetings were not included in the penalty.
Facts:
Following the running of race 9, Donaghys Pure Flush 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Mr Bakar permitted his mount DON’TBLAMETHEMUSIC to shift outwards when not sufficiently clear of INCA WARRIOR which was checked near the 100 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Bakar said he understood the Rule and confirmed that he admitted the breach.
Mr N Harris assisted Mr Bakar at the hearing.
Mr Oatham demonstrated the incident using the available video footage. He identified that at the 400 metres Mr Bakar was racing in a 2 wide position. He said in the final straight Mr Bakar continued to ride his mount forward when it was shifting outwards. He said although Mr Bakar did make some effort to straighten his mount he needed to make a greater effort to avoid causing interference. He identified that near the 100 metres DON’TBLAMETHEMUSIC shifted out when only a bare length clear of INCA WARRIOR which was checked.
Mr Bakar accepted Mr Oatham’s interpretation of the incident.
Mr Harris identified on the video film that Mr Bakar lost his balance when his mount was shifting outwards. He said that Mr Bakar needs to modify his style when riding out a finish.
Submissions for Penalty:
Mr Coles produced Mr Bakar’s record which showed 2 previous breaches under this Rule. He said that Mr Bakar has had 7 wins from 16 rides to date in his career. He described the level of carelessness as mid-range and a suspension in line with that would be appropriate.
Mr Oatham contacted Mr Bakar’s employer Mr Richards who advised that any proposed suspension could start after racing at Tauranga on 19 October.
Mr Harris asked the Committee to consider that DON’TBLAMETHEMUSIC has raced erratically previously on a right handed track.

The Committee carefully considered all the evidence and submissions presented.
It was clear of the video films that Mr Bakar permitted his mount to shift out from the 400 metres to the 100 metres. Mr Bakar failed to take the necessary corrective action and as a consequence INCA WARRIOR was briefly crowded and checked passing the 100 metres. At that point DON’TBLAMETHEMUSIC was only one length clear of INCA WARRIOR. The Committee deemed the level of carelessness displayed by Mr Bakar was mid-range.
The JCA Penalty Guide starting point for mid-range carelessness is 8 days which was adopted.
Mr Bakar’s record is not good with today being his 3rd careless riding charge from just 16 race day rides. This is an aggravating factor which necessitates a 1 day uplift in penalty.
The mitigating factors were Mr Bakar’s admission of the breach and his inexperience. For these combined factors a 1 day reduction was applied.
After taking into account all the above factors the Committee considered that an appropriate suspension was 8 national riding days.
