After taking all the above factors into account we impose a suspension on Mr Jago from riding in races which is to start after racing on 14 November and conclude after racing on 24 November 2010 (5 riding days)

Following race 8 an Information was filed pursuant to rule 638 (1) (d). The informant Mr Oatham alleged that Mr Jago permitted his mount PINNAFERO to shift inwards passing the 1400 metres when not sufficiently clear of LADY CHAPARRAL (C Lammas) which was

Mr Robinson demonstrated the video films which showed Mr Jago riding PINNAFERO angle his mount inwards towards the rail at a point approaching the 1400 metres. The films showed he was insufficiently clear of LADY CHAPARRAL which received a sharp check as a result.

Mr Jago told the committee he was unaware that Mr Lammas was there behind him as he was following Mrs Thornton over to the fence.

Mr Oatham said Mr Jago had a good record which showed one charge in the last 12 months. However he asked the committee to take into account this was a Group 3 race. Mr Oatham submitted the breach was in the mid range.

 
Mr Jago told the committee he did not have any confirmed rides after 14 November 2010.

Reasons for Penalty:

The committee carefully considered all evidence and submissions. Mitigating factors are Mr Jago’s very good record and his admission of the breach. However Mr Lammas did receive a reasonably sharp check as a result of Mr Jago moving in when insufficiently clear. The committee has also taken into account this interference occurred in a Group 3 race of $70,000.
