As Mr Goindasamy admitted the breach the Committee found the charge proved.
Penalty:
The Committee grants a deferment to Mr Goindasamy’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Goindasamy had his license to ride in races suspended for a period to commence after racing on 22 December and conclude after racing on 2 January 2019.
The race meeting scheduled for Gore on 23 December was not included in the penalty because the declaration of riders had closed.
Facts:
Following the running of race 8, Noble & Lee 1600, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Jones, alleged that Mr Goindasamy permitted his mount LADYNADEL to shift outwards when not sufficiently clear of HAVOC which was checked near the 250 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Goindasamy said that he understood the Rule and confirmed he admitted the breach.
Mr Harris assisted Mr Goindasamy at the hearing.
Mr Coles demonstrated the incident using the available video footage. He identified that near the 300 metres LADYNADEL was racing directly behind LADY PAINTON. He said there was no run available for Mr Goindasamy and identified that HAVOC was racing on his outside. He said Mr Goindasamy improved his position and shifted out when not sufficiently clear of HAVOC. As a consequence Mr Lammas, the rider of HAVOC, had to steady his mount for half a dozen strides and go back to the inside for a clear run.
Mr Goindasamy told the Committee that he accepted Mr Coles’ interpretation of the incident and had nothing to add.
Mr Harris said that Mr Goindasamy allowed his mount to shift ground when he was trying to organise his whip. He said that Mr Goindasamy needs to concentrate more on steering his mounts and keeping a straight line of running.
Submissions for Penalty:
Mr Jones produced Mr Goindasamy's record which showed 3 previous breaches of this Rule within the last 12 months, the most recent being 31 October. He said Mr Goindasamy record was not good because he has had only 115 rides to date this year. He described the level of carelessness as below midrange.
Mr Goindasamy advised that he had engagements on 22 December and any proposed suspension could start after that date.
Mr Harris submitted that Mr Goindasamy was still learning from his experiences.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video films the Committee found that passing the 300 metres Mr Goindasamy looked to his outside prior to angling his mount out. Shortly after that point Mr Goindasamy allowed his mount to shift out 1 horse width when only 1 length clear of HAVOC. Mr Goindasamy erred in continuing to ride his mount forward when it was shifting ground. As a result he shifted out a further 2 horse widths and HAVOC was crowded and checked losing ground. The Committee deemed the level of carelessness displayed by Mr Goindasamy was in the low to midrange.
The JCA Penalty Guide starting point for low to midrange carelessness is 7 national riding days which was adopted.
Mr Goindasamy’s record was deemed to be substandard with today being his 4th breach from 115 rides over a period of 7 months. This warranted a 1 day uplift in penalty.
The mitigating factor was Mr Goindasamy’s admission of the breach. For this he was afforded a 1 day reduction in penalty
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
