Penalty:
The Committee granted a deferment to Mr Calder suspension pursuant to Rule 1106(2).
Accordingly, Mr Calder had his license to ride in races suspended for a period to commence after racing on 1 January and conclude after racing on 12 January 2019.
Facts:
Following the running of race 4, Shaw’s Wire Ropes Uncle Remus Stakes, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Calder permitted his mount (TIGER SILK) to shift inwards when not clear of MR UNIVERSE (S McKay) near the 1100 metres resulting in MR UNIVERSE clipping a heel.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Calder said that he understood the Rule and confirmed he admitted the breach.
Mr Coles demonstrated the incident using the available video footage. He identified that Mr Calder allowed his mount to shift in near the 1100 metres when only ¾ to 1 length clear of MR UNIVERSE. He said that as a consequence MR UNIVERSE clipped a heel and he believed that Mr Calder made an error of judgement.
Mr Calder told the Committee that he agreed with the Stewards' interpretation of the incident. He said that the video films clearly showed the interference. He added that he was racing in the open from a wide draw and he thought he was clear of MR UNIVERSE when he shifted in.
Submissions for Penalty:
Mr Oatham produced Mr Calder’s record which showed 1 previous suspension since he resumed riding in New Zealand at the end of April in 2018. He said it was Mr Calder’s only suspension from 291 rides and on that basis he had a good record. Mr Oatham said that there was significant interference to MR UNIVERSE and it was lucky that there was no fall involved. He described the level of carelessness as midrange or a touch above and he asked the Committee to take into account that the breach occurred in a Listed race worth $60,000.
Mr Calder advised the Committee that he had firm engagements up to and including 1 January 2019 and he sought a deferment to his proposed suspension. He added that he agreed with the Stewards' submissions as to penalty.

The Committee carefully considered all the evidence and submissions presented.
When reviewing the video films the Committee found that after jumping from the outside gate (10), Mr Calder allowed TIGER SILK to shift inwards in a gradual manner. Near the 1200 metres TIGER SILK was improving past MR UNIVERSE. Shortly after that point Mr Calder allowed his mount to shift in when only ¾ of a length clear of MR UNIVERSE. As a result that runner clipped a heel, blundered badly and almost dislodged its rider Mr McKay.
The Committee deemed the level of carelessness displayed by Mr Calder was midrange.
The JCA Penalty Guide starting point for midrange careless riding is 8 national riding days which was adopted.
We deemed a 1 day uplift was appropriate for the status of the race, namely a Listed race with stake money of $60,000.
The mitigating factors were Mr Calder’s admission of the breach and his good record. For these combined factors Mr Calder was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 8 national riding days.
