After considering the evidence and the submissions and after viewing the films the Committee is satisfied that the gates opened only marginally earlier than the others and IFFRAAJINATOR did not gain an advantage.

Facts:

Following the running of the TUAKAU COSSIE CLUB 1200 a Request for a Ruling was filed by Stipendiary Steward Mr A Coles pursuant to Rule 632(2) to seek a Ruling as to whether IFFRAAJINATOR had gained an advantage when it forced its Barrier Gates to open early.

Rule 632(2) provides: If, in the opinion of the Judicial Committee, any horse gained an unfair advantage by its barrier stall malfunctioning and opening, or being forced, by such horse, open prior to the starter effecting a start, such horse may be declared a non starter.

Mr Coles demonstrated the incident by use of the race films and showed where the gate for IFFRAAJINATOR'S stall opened slightly before the other gates opened. The head on film showed that the gate had only opened slightly and the side on film showed that it had opened marginally ahead of the others.

Miss Spratt the rider of IFFRAAJINATOR said that she was not aware that her horse had forced the gate open and she said it didn't make any difference to her horse's start. She said that she did not believe that her horse had gained an advantage but rather that it had lost half a length.

Mr Coles submitted that there was very little in the incident and his view was that IFFRAAJINATOR had not gained an advantage.

Miss Spratt confirmed her evidence saying that in her opinion IFFRAAJINATOR had not gained an advantage .

Reasons for Decision:

Pursuant to Rule 632(2) the Committee ruled that IFFRAAJINATOR did not gain an advantage and therefore the Judge's placings stand.

It is ordered that dividends and stakes be paid in accordance with the Judge's placings.
