As Mr Eales admitted the breach the charge was found to be proved.

Penalty:

Taking into account all of the submissions and applying mitigation factors we imposed a monetary penalty of $300.

Facts:

Information number A7655 was presented to the Judicial Committee alleging a breach of Rule 614 (2) in that Mr Eales neglected to include the leadbag when initially saddling EXPEDITE.

Rule 614(2) states:

A person must not be neglectful or careless in saddling a horse.

Mr Goodwin explained how the error was picked, up prior to Race 6, by Assistant Stipendiary Steward, Mr Bateup, during routine checks in the back parade ring. Once he noticed the lead bag was not in place EXPEDITE was sent back to be re-saddled.

Mr Eales readily admitted his mistake saying he had experienced a “brain fade”. The lead bag was found to have slipped off the partition where it had initially been placed.

Submissions for Penalty:

Mr Goodwin submitted that this breach could be dealt with by way of a monetary penalty. EXPEDITE was re-saddled and raced with the correct weight. Prior to the introduction of routine checking by Stipendiary Stewards this situation would have been far more serious with the horse racing and almost certainly being disqualified for not carrying correct weight.

Mr Goodwin cited recent similar breaches which had incurred fines in the range of $300 - $500.

Reasons for Penalty:

The Committee referred to the Penalty Guide for Judicial Committees which has, as a starting point for a breach of this type, a $500 fine.

Mr Eales admitted the breach and the horse was re-saddled quickly with no delay to the start of the race as a consequence. This was the first time that Mr Eales has omitted to attach a lead bag to any of his runners.
