Facts:

Mr Renault, Stipendiary Steward, alleged that Ms Butt used her whip on more occasions than permitted in clause (b) of the Use of the Whip Regulations on her drive GLENISTHEBETTOR in race 8, the SPEIGHTS MOBILE PACE.

Rule 869 provides as follows:
(2) No horsewoman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:
(b) No horsewoman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Ms Butt indicated on the information that she admitted the breach and did not wish to be present at the hearing. Mr Renault confirmed to the Committee that Ms Butt had had the assistance of Open Horseman, Mr Orange when she made this decision.

Mr Renault demonstrated the alleged breach on the videos. He pointed out Ms Butt, who had been held up on the turn, had used her whip 12 times in the last 400 metres when taking a run in the passing lane. There was the odd pause but many of the strikes were in quick succession. There was a tap as the field rounded the home bend that Mr Renault did not include in the count.

Submissions for Penalty:

The penalty is determined by a sliding scale. Where the number of strikes is 11 to 13 and it is a first offence, it is $200. The count for Ms Butt is 12. She agrees that this is the number. Ms Butt has had 207 drives this season, and 218 last season.

Reasons for Penalty:

This is Ms Butt’s first breach of this rule since the regulations came into force on 30 November. The Use of the Whip Regulations provide for a fine of $200. There are no aggravating or mitigating factors of the breach.
