Accordingly after taking all the above into account we impose a fine of $150.

Facts:

Following race 5 an information was filed pursuant to rule 638 (30(b). The informant Mr Coles alleged that Mr McKay used the whip in an excessive manner on his mount BRICK HOUSE.

Submissions for Decision:

Mr Coles told the committee that Mr McKay struck his mount 15 times prior to the 200 metres without giving the required respite of 6 strides. Mr Coles acknowledged that after the first 5 strikes Mr McKay paused for 4 strides but then continued to strike his mount for another 12 strides without respite.
Mr P McKay on behalf of Mr J McKay said Mr J McKay misjudged the 200 metre mark and acknowledged he did not give the required respite of 6 strides.

Submissions for Penalty:

Mr Coles submitted that a breach of this rule generally attracted a fine of $200. However he pointed out that amateur riders as is Mr McKay do not get paid and he had had very few rides.
Mr P McKay submitted that Mr J McKay only had 1 ride a month and did not receive any riding fees. He said he had learnt a lesson from this incident.

Reasons for Penalty:

The committee considered that this was Mr McKay’s first charge under this rule and his admission of the breach. Mr McKay’s amateur status is also a mitigating factor.
