As the breach of the rule was admitted we find the charged proved.
Penalty:
Miss Ottley was fined the sum of $250.00.
The committee in fixing penalty took into account Miss Ottley’s admittance of the breach and we accepted that the breach was at the mid range level.
The committee also considered that there was some mitigation in that Mr O’Connor drove up his horse Big Rocket which did not assist the situation.
The committee commended Miss Ottley for her honesty and also stated that she was a Junior Horsewoman showing a great deal of promise and she was reminded to simply take more care in a similar type situation in the future.
Charge:
At the conclusion of race 2 the Otago Architectural Painters Mobile Pace an information was lodged by Stipendiary Steward Mr N. G. McIntyre alleging under rule 869(4) that Junior Horsewoman Miss S. Ottley (Waihemo Caesar) shifted inwards after approximately 250metres when not clear of Collecting (M. P. Jones) and Big Rocket (B. O’Connor) resulting in both runners having to check.
The rule reads:
No horseman shall during any race do anything which interferes of is likely to interfere with his own horse and /or any other horse or it’s progress.
Miss Ottley admitted the breach of the rule.
Facts:
Mr Allison (Stipendiary Steward) used several video clips of the alleged incident highlighting in his opinion the inwards movement by Waihemo Caesar driven by Miss S. Ottley.
Mr Allison stated that Mr Beck who drove Colleen Patricia went to the front on this horse with Mr O’Connor driving Big Rocket eased to the rear with Mr Jones racing on the outside of Big Rocket.
Miss Ottley was racing in the three wide position at the rear of the field and moved inwards forcing Mr Jones also inwards onto Mr O’Connor whose horse Big Rocket ran over a number of pylons.
Miss Ottley in Mr Allison’s opinion had exposed both Mr Jones and Mr O’Connor to an awkward situation.
Mr Jones stated that Mr O’Connor had pushed up and locked stays which he could not clear immediately. Mr Jones also said that Miss Ottley may not have seen Mr O’Connor push up.
Miss Ottley said she had made an error of judgment and that she certainly did not see Mr O’Connor push up on the inside of Mr Jones who was racing in the two wide position.
Submissions for Penalty:
Mr McIntyre stated that Miss Ottley had a relatively good record having received a charge under this rule 10 months ago.
Miss Ottley had 109 drives last season and up to date in this new season she has had 68 drives and 100 drives since the last breach.
Mr McIntyre believed that the breach was in the mid range of the scale.
Miss Ottley had no submissions on penalty.
Reasons for Penalty:
The committee was clearly satisfied that a breach of the rule had occurred. The video evidence was conclusive along with Mr Allison’s statements confirming that Miss Ottley had moved inwards when not sufficiently clear.
