Facts:
Following the running of race 2 the SOUTHERN WINES FILLES & MARES MOBILE PACE the Stewards lodged an information under Rule 870(5) alleging the fourth placed ARMBRO BELLBIRD was in its incorrect gail and was lapped on by the fifth placed SANCY at the finish line.
Rule 870(5) reads:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose touches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation shall be at the discretion of the Judicial Committee.

Mr Allison, will the aid of the head-on and side-on videos, showed the relevant position of ARMBRO BELLBIRD as the field approached the final 100m. He stated ARMBRO BELLBIRD paced roughly for several strides prior to the 50m mark before breaking and galloping across the finish line in fourth position.
He said ARMBRO BELLBIRD was not in its correct gait at the finish and was lapped on by SANCY in breach of Rule 870(5). He was seeking the relegation of ARMBRO BELLBIRD from fourth to fifth placing.
Mr McCormick stated the aged mare was having its first start and agreed it had broken free of interference.
Reasons for Decision:
The committee is satisfied that ARMBRO BELLBIRD broke from its gait, free of interference, and was not in its correct gait at the finish line when lapped on by SANCY.
ARMBRO BELLBIRD is relegated under the provisions of Rule 870(5) and SANCY is promoted to fourth placing.
