Due to the Committee’s finding the Protest fourth against third was dismissed.

Facts:

Following the running of Race 6 (Hawkes Bay Breeders Gold Trail Stakes) Information No. A11651 was filed with the Judicial Committee. Mr S Ritchie the Trainer of the fourth placed horse JENNIFER ECCLES, protested against the third placed horse LOIRE, on the grounds of interference in the home straight.

All present said that they understood the Protest Rule.

The Judge’s Placings were:

1st-No.1-ARETHA
-2nd-No.3-BAVELLA
-3RD-No.10-LOIRE
-4th-No.9-JENNIFER ECCLES

The Margin between third and fourth was half a head.

Submissions for Decision:

After viewing all film replays without comment, Mr Ritchie said that LOIRE pushed in on JENNIFER ECCLES near the 300m and cost JENNIFER ECCLES half a head to a neck. He said that the interference certainly cost his horse third placing as it was only beaten for that position by half a head. He added that JENNIFER ECCLES was relegated at the last Hawkes Bay Meeting for a similar sort of incident.

Mr Mansour (JENNIFER ECCLES) said that when his horse got hit it swayed for some time. He added that after it got bumped it became nervous.

Mr Pike said that LOIRE was not to blame. He said that KALI who was on the inside, shifted out onto JENNIFER ECCLES, who went out onto LOIRE and that BAVELLA also shifted out one horse width. He added that JENNIFER ECCLES had clear running from the 200m and had ample opportunity to make up ground.

Mr Coleman said that LOIRE did lay in when contacted from the inside. He added that KALI shifted out initially and that BAVELLA also shifted out slightly. He said that his horse came back well over the final 150m to finish third.

Mr Oatham for the Stipendiary Stewards said that early in the straight KALI shifted out and that BAVELLA also shifted out. He said at that time JENNIFER ECCLES was not fully into the gap. He said that LOIRE did shift in, but that JENNIFER ECCLES then headed LOIRE, and over the final stages LOIRE came back to head that runner.

Reasons for Decision:

After considering all of the submissions and reviewing the film replays the Committee was satisfied that some interference occurred early in the run home. It was the Committee’s opinion that the initial movement was from KALI who shifted outwards towards JENNIFER ECCLES who in turn made contact with the hindquarters of LOIRE which resulted in LOIRE turning inwards marginally. Both JENNIFER ECCLES and LOIRE raced tightly for some strides before coming apart. It was observed that near the 100m JENNIFER ECCLES had a margin over LOIRE of approximately half a neck. LOIRE was then observed to finish strongly to make up that leeway and beat JENNIFER ECCLES by half a head. At the time of the interference taking place, BAVELLA may also have contributed, due to shifting about when only marginally clear.
