As Mrs Allpress admitted the breach the charge was deemed proved.

Penalty:

Accordingly, Mrs Allpress’ license is suspended from the close of racing today Sunday, March 17th up to and including racing on Monday, March 25th 2019.

Facts:

Following the running of Race 1 (Tui Backing a Winner Since 1889), an Information was lodged by Mr Neil Goodwin alleging a breach of Rule 638(1) (d) in that L Allpress allowed her mount LA SOEUR to shift inwards when not clear of AMORATA which was dictated inwards onto ALL IN STITCHES which was tightened and checked.

Using the available videos Mr Balcombe identified the runners involved and Mr Goodwin explained the incident.

Near the 1000m Mrs Allpress was racing at the rear of the field with Charlotte O’Bierne to her outside. Directly in front of Mrs Allpress was Mr Johnson (AMORATA) and in front of him Ms Andrew (ALL IN STITCHES). Due to the pace slowing Mrs Allpress elected to go forward by easing Ms O’Bierne out. This manoeuvre placed Mrs Allpress in a four-wide position and allowed Mr Johnson room to improve on her inside. The three runners involved then entered the corner almost side by side with LA SOEUR maybe a neck in front. Mrs Allpress allowed her mount to roll in dictating Mr Johnson onto Ms Andrew who was checked.

Mr Goodwin said the Stewards classed the carelessness to be near midrange and called for a term of suspension.

Mrs Allpress said she was concerned by the slow pace when racing at the rear of the field and worried she might clip heels. With this in mind, she angled out and pushed forward. Unaware that Mr Johnson had pushed up into the three-wide position, she then moved back down on the point of the turn. Mrs Allpress concurred that by moving inwards, she forced Mr Johnson’s mount onto Ms Andrews causing her to be checked.

Mrs Allpress said she had no riding commitments within the next seven days and any suspension could begin immediately.

Reasons for Penalty:

The Committee placed the degree of carelessness at just below midrange. Mrs Allpress clearly failed to maintain her correct line of running, but the incident was exacerbated by the fact it occurred right on the point of the turn. We adopted a starting point of 7 days. Mrs Allpress is a very busy rider and viewing her record spread out over the previous 12 months we were prepared to consider it a neutral factor. We have given Mrs Allpress credit for her admission of the breach. Balancing up all factors it was the Committee’s opinion that, a six-day suspension was an appropriate penalty.
