As the charge was admitted, the committee found the charge proved.

Mr Reid is fined $300.

Facts:

Following the running of Race 7 (New Plymouth Trainers Amateur Rider 2100m), Information A2749 was filed with the judicial committee. It alleged a breach of Rule 638(3)(b) in that J Reid used his whip "in an excessive manner prior to the 200 metres on a runner that was out of contention."

Mr Reid, assisted by Mr Gray, confirmed that he understood the rule and that he admitted the breach.

Mr Goodwin confirmed that the charge in this instance related to excessive use of the whip. Using the side-on film, Mr Goodwin identified Mr Reid using his whip on LAST TRUMP soon after the field straightened for the run home. He was observed to strike his horse approximately 10 times from the 450m while his horse was towards the rear of the field and clearly out of contention. Mr Reid had no comment to make. Mr Gray, assisting Mr Reid, observed the excessive use as awkward strokes and that the film demonstrated Mr Reid's "very very poor" whip action. Mr Gray submitted this lack of experience could be explained by Mr Reid's amateur rider status. 

Submissions for Penalty:

Mr Goodwin identified no previous breaches of this rule within the previous 12 months. He submitted a fine at a level less than the $500 JCA Penalty Guidelines starting point as appropriate. Mr Reid advised the committee that he had ridden last season and that he clearly had an issue with his whip action as he had also previously received a fine for his excessive use of the whip just over 12 months ago, along with a warning at Ellerslie in June of this year.

Mr Gray asked the committee to take into consideration Mr Reid's amateur status and that such an unco-ordinated approach to whip action could be expected from a rider of such capability. 

Reasons for Penalty:

The committee considered all of the submissions placed before it. Excessive whip use has a very negative public perception and the starting points for this offence have been adjusted upwards to reflect this. While Mr Reid's record under this rule for the pervious 12 months could be described as good, that is balanced by what will be two breaches of the rule in just over 12 months for someone with very limited riding opportunities. Mr Reid had clearly shown remorse and had acknowledged that he had to do something about his whip action. He had also admitted the breach at the earliest opportunity and was co-operative during the judicial process. These collective factors mitigate the fine downwards from the $500 starting point.
