As Ms Mundy admitted the charge it is therefore deemed to be proved.

Penalty:

A fine of $250 is considered appropriate and Ms Mundy is fined accordingly.

Charge:

A Mundy rider of “The Meista” used her whip in an excessive manner prior to the 200m mark.

Facts:

Following the running of race 7, “The Couplands Bakeries Timaru Cup” was charged pursuant to rule 638 (3) (b) of the Rules of Racing, which reads:

“A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper”.

Mr Davidson advised that the charge related to excessive use of the whip. He showed the incident on video coverage, which revealed Ms Mundy, struck her mount with the whip between 12 and 14 times prior to the 200m mark. This was a clear breach of the “Guidelines for Whip Use”.

Ms Mundy had no comments to make.

Submissions for Penalty:

Mr Davidson advised that this charge was the second time Ms Mundy had been charged with a breach of this rule in the last 12 months. He said that she was co-operative with Stewards and had admitted the charge at the earliest opportunity. He submitted that a fine between $200 and $300 should be imposed.

Ms Mundy had no comment to make on the question of penalty.
