Facts:

Following the running of the IRT-YOUR HORSE OUR PASSION HANDICAP TROT an Information instigating a Protest was lodged by Senior Stipendiary Steward Mr S Mulcay against the second placing of KAY CEE on the grounds of breaking from its gait and galloping in excess of 50 metres in the last 200 metres of the race.

Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its proper gait.

The Breaking Horses Regulations provide: that if any horse breaks from its gait during the  last 200 metres of a race and gallops in excess of 200 metres is deemed  to be in breach of Rule 870(3) and shall be disqualified from the race.

Mr J Dickie the Trainer/Driver of KAY CEE endorsed the Information with the words " I do not contest the Protest"

Mr Mulcay demonstrated the incident by use of the race films and showed where KAY CEE broke outside the 50 metres mark and galloped from there to past the winning post.

Submissions for Decision:

Mr Mulcay submitted that KAY CEE was in breach of Rule 870(3) and should be disqualified from the race.
