In light of Mr Edge’s admission of the charge and the clear video evidence of excessive use of the whip the breach was found proved.

Penalty:

Mr Edge is fined $300.00 for his clear excessive use of the whip on this occasion.

Facts:

Following the running of Race 1, the Mediaworks Race Night Mobile Pace (Amateur Drivers), an information was laid by Stipendiary Steward Mr S P Renault against Mr A Edge, alleging a breach of Rule 869(2)(A), in that Mr Edge “…used his whip excessively when driving “Waihemo Art””.

Rule 869(2)(A) reads:

“No horseman shall…use his whip in an unnecessary, excessive or improper manner”.

Mr Edge admitted the charge in writing and did not attend the hearing.

Through video evidence Mr Renault showed Mr Edge strike Waihemo Art with the whip approximately 27 to 28 times during its run down the home straight to the finish.

Submissions for Penalty:

Mr Renault pointed to Mr Edge’s clean record over the last six months and pointed out that Mr Edge was a busy amateur driver having 31 races last season and 26 drives the season before. In light of his good record and his admission Mr Renault proposed a fine of $300.00.

Reasons for Penalty:

After hearing the submissions the Committee took into account Mr Edge’s admission of the breach and in light of his good record it determined that he be fined as proposed. Taking a starting point of $500 there will be a discount of $100 for each of the mitigating factors identified.
