As Mr Coleman admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, the Committee imposes a suspension on Mr Coleman which will commence after racing on 30 August and conclude after racing on 4 September 2014 (3 North Island days).

Facts:

Following the running of race 7, Pentire @ Rich Hill Stud 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that near the 250 metres Mr Coleman permitted his mount THAT’S HOW WE ROLL to shift out, when not sufficiently clear of HAYLEY GRACE which clipped a heel and blundered.

Mr Coleman acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson identified on the head – on film that near the 250 metres THAT’S HOW WE ROLL was racing in an approximately 5 wide position with HAYLEY GRACE directly to his outside. He said THAT’S HOW WE ROLL was travelling well at that point and Mr Coleman commenced to shift ground out. In doing so this put HAYLEY’S GRACE in restricted room which resulted in her clipping a heel.

Mr Williamson said in mitigation CALL THE SHOTS who was racing directly in front of THAT’S HOW WE ROLL did shift out and SOPHIES GEM moved in slightly. In summing up he said there was no run available for Mr Coleman when he was endeavouring to improve.

Mr Coleman advised the Committee that he agreed with Mr Williamson interpretation of the incident. He confirmed that CALL THE SHOTS did shift out about 1 horse width but conceded he should have stopped riding forward. He added it was an error of judgement on his part which placed Mr Hain in restricted room.

Submissions for Penalty:

Mr Oatham produced Mr Coelman’s record which showed no previous breach under this Rule in the last 12 months, his most recent being on 16 December 2012 which attracted a 4 day suspension. He described Mr Coleman's record as excellent and he ought to be given credit for his admission of the breach, his honesty and the mitigating factors Mr Williamson demonstrated on the films. Mr Oatham submitted the level of carelessness was at the low end and a suspension in line with that would be appropriate.

Mr Coleman advised that he had upcoming engagements at Hastings on 30 August, and any proposed suspension could commence after that. Mr Coleman asked the Committee to take into account his excellent record and admission of the breach.

Mr Coleman confirmed that he rode only in the North Island.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension. The significant mitigating factors are Mr Coleman’s admission of the breach, his exceptional record in relation to this Rule, his forthrightness during the hearing and the level of carelessness is at the low end.

The NZTR records show that Mr Coleman had 539 rides for the 2013–2014 season and his last suspension occurred in December 2012. The Committee commended Mr Coleman on this exceptional record.

After taking into account all the significant mitigating factors this Committee firmly considers an appropriate penalty is a 3 day suspension.
