Penalty:

Ms O’Beirne’s Apprentice Jockey’s Licence was suspended from the end of racing on 29 April up to and including racing on 6 May 2018 (5 riding days).

Facts:

Following the running of race 8 (Kawi Cup), Information No. A9220 was filed with the Judicial Committee. The Informant alleged that Apprentice Jockey, Ms C O’Beirne, the rider of TOMS angled her mount outwards when not sufficiently clear of DAL SIR TEE which was crowded then checked near the 300m.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the judicial Committee considers to be careless

Ms O’Beirne and Mr Haworth said that they understood the Rule, Charge and confirmed to the Committee that the breach was admitted.

Mr Oatham identified the horses involved on the film replays. He said that Ms O’Beirne came away from the trail to be racing outside EXONERATE. He said that Ms O’Beirne then continued on an outward movement and tightened and then checked DAL SIR TEE. Mr Oatham added that there was some minor contribution from the outside due to a runner shifting in. He estimated that Ms O’Beirne and her mount were only a half-length clear of DAL SIR TEE when shifting out.

Mr Haworth said that there was little to be said, that the breach had been admitted, that it was an error of judgement and he hoped that Ms O’Beirne would learn from her mistake.

Ms O’Beirne said that she should not have angled out when she did.

Submissions for Penalty:

Mr Balcombe said that Ms O’Beirne had a clear record since recommencing her riding career in September 2017. He placed the carelessness in the low to mid-range category and added that it was an error of judgement on Ms O’Beirne’s part and called for a term of suspension.

Ms O’Beirne said that she intended riding at the Marlborough meeting on 29 April 2018 and would like any suspension imposed to commence after that date.

Reasons for Penalty:

The Committee was satisfied that Ms O’Beirne did shift her horse away from the trail when not clear of DAL SIR TEE near the 300m, with the consequence being that DAL SIR TEE was tightened and checked. The Committee noted that there was some contribution to the incident due to an outside runner shifting inwards marginally.

The JCA Penalty Guideline has a starting point of 6 riding days suspension for careless riding. Taking into account the clear record, the admission of the breach and that in the opinion of the Committee the carelessness was low-range, it was determined that a 5 riding-day suspension was an appropriate penalty.
