Charge:

The information alleged that Mr S McCaffrey presented himself without an approved safety vest prior to the start of race 2 when driving the horse ‘Georgia Brooke’.

Facts:

Stipendiary Steward Mr B Van Kan told the Committee that prior to the start of Race 2 he had seen Mr McCaffrey changing his driving colours and noticed that he appeared to be not wearing a safety vest. He stated that he had approached Mr McCaffrey and asked him if he was wearing a safety vest, to which Mr McCaffrey had replied in the negative.

Mr McCaffrey, in explanation, told the Committee that because the registered colours for ‘Georgia Brooke’ were unavailable at the time when he took the horse onto the track he had worn his stable colours. He was then handed the correct colours and in his haste to change into them had inadvertently forgotten to put his vest on. He admitted that it was his mistake. 

Reasons for Decision:

The charge having been admitted is accordingly proved.

Submissions for Penalty:

Mr Van Kan advised that the JCA Guidelines provided for a penalty of suspension for 10 drives or a fine of $500.

The Committee was informed by Stipendiary Steward Mr J Muirhead that the issue at hand was about safety, and that there were implications for the Harness Club in respect of Occupational Safety and Health matters if an accident were to occur when a driver was not wearing approved safety gear.

Mr McCaffrey asked for some leniency, given that he had not attempted to be deceptive and he added that he hadn’t raced without wearing a vest.

Reasons for Penalty:

Mr McCaffrey for his part admitted the breach, and a mitigating factor to his benefit is that he did not actually race without a safety vest.
