Accordingly, the Committee declared COAT DU ROAN to be a starter.
Facts:
Following race 7, an information was filed pursuant to Rule 632. The informant, Mr Molloy requested a ruling as to whether COAT DU ROAN was denied a fair start.
Mr Williamson read the rule and Mr Molloy acknowledged that he understood it.
Rule 632 states:
“(1) If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
Submissions for Decision:
Mr Molloy submitted he felt COAT DU ROAN was dealt a gross injustice at the start of the race. He explained to the committee that he understood how the barriers functioned. He believed his filly had been in the barriers too long and “lost control of her emotions”. He demonstrated the head on film which showed COAT DU ROAN was up in the air several times. He believed COAT DU ROAN came back down as the gates opened and she landed flat footed. He also pointed out that her rider had his feet out of the irons.
Mr Sargent who started the race submitted that COAT DU ROAN had reared a couple of times and unseated Mr Turner. He said he asked Mr Turner twice was he ready, he replied yes go. He said he called out to all riders “watch your gates” and had committed to push the start button when COAT DU ROAN reared again. He submitted that there was no mechanical fault. In his opinion the reason she was slow to jump was because of her behaviour.
Mr Harrison submitted he had taught Mr Sargent once you have committed to push the button don't stop because ¾ of the field will charge the gates. He believed COAT DU ROAN was in a tardy mood. He said he heard Mr Turner yell out go to Mr Sargent. He said he noted Mr Turner was on the side of the gates for his own protection from the horse.
Mr Turner submitted that COAT DU ROAN had reared up several times and he called out to the starter to go. However, he said there was a delay before the gates opened which gave COAT DU ROAN time to rear again.
Mr Molloy added it appeared that when the gates opened the attendant was still holding onto her.
Mr Williamson submitted that COAT DU ROAN reared on 3 occasions and the onus was on the horse to be ready. He said the race was started on Mr Turner’s say so to proceed. He said the attendant was in contact with COAT DU ROAN. He submitted he would leave it to the committee to decide if COAT DU ROAN was denied a fair start.
When asked by the committee Mr Molloy submitted he had nothing further to add.
Reasons for Decision:
The Committee carefully considered all the submissions presented. We reviewed the video films of the start several times frame by frame. It was clearly obvious COAT DU ROAN reared up on 3 occasions. When the gates opened COAT DU ROAN had all 4 feet on the ground however, it is clear Mr Turner was not positioned in the saddle correctly. It is clear that COAT DU ROAN just stood there when the gates did open. The attendant was in the process of releasing COAT DU ROAN when the gates opened. There was no sign of mechanical failure of the starting stalls this was confirmed by the starter. Taking into account all the above factors we are of the view COAT DU ROAN was slow away by its own accord.
