As Mr Riddell admitted the breach the charge was found to be proved.

Taking all of these matters into consideration Mr Riddell was fined the sum of $300.00
Charge:
Mr Riddell was charged with a breach of Rule 330(3)(c) in that he failed to make the carded weight for ALBUS in race 4.
Facts:
ALBUS was listed in the race book to carry 56kgs however prior to race 1 Mr Riddell advised the stewards that he would be at least 1kg overweight. Mr Tinsley was the replacement rider.
Mr Riddell explained that he struggled with his weight and had recently required medical help during a race day after wasting to ride. He said that he was well aware of his obligations when accepting rides and was regretful that he had made this mistake today.
Submissions for Penalty:
Mr Oatham said that Mr Riddell had 4 previous overweight charges within the last 12 months. The two most recent charges were in October and December last year and were both met with $100 fines.
Mr Oatham submitted that in this instance a $200 fine was a reasonable penalty.
Mr Riddell had nothing further to add.
Reasons for Penalty:
In determining penalty the committee took into account Mr Riddell's early and frank admission of the breach and his personal circumstances.
Aggravating features were his poor record and the fact that the owners of ALBUS were required to find a replacement rider on a premier day. It was fortunate that another senior and accomplished rider was available.
