As Mr Hutchings admitted the breach we found the charge proved.
Penalty:
Mr Hutchings is suspended from the close of racing on Wednesday April 18th up to and including racing on Monday April 23rd. The committee included all NZ race days in the penalty after accepting Mr Hutchings rides throughout the country.
Charge:
Following the running of Race 8, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that passing the 400m R Hutchings has permitted his mount THE LAST AL to shift out when not clear of FIREKEEPER which was tightened and checked.
Facts:
Mr Goodwin said on rounding the bend for home Mr Hutchings was racing in a position directly behind Mr Riddell with Mr Tinsley to his outside. At the 400 metres a gap opened to the outside of Mr Riddell which Mr Hutchings tried to take, however Mr Tinsley already “had ownership” of the gap and there was no room for both of them. Mr Tinsley was forced to take a hold of his mount and check out of the gap. Mr Goodwin showed on the head-on view Mr Riddell shifting outwards slightly but said this was after the incident involving Mr Hutchings had already occurred.
Mr Hutchings said movement from other horses around him at the time made the incident look worse than it was.
As Mr Hutchings is an apprentice rider Mr Noel Harris came into the hearing to assist him. This was only arranged minutes before the hearing began and the Chairman of the committee suggested to the Stewards that Mr Harris (or another person) should have been involved in assisting Mr Hutchings much earlier and certainly prior to him admitting the breach.
Submissions for Penalty:
Mr Goodwin said the offence was in the mid-range. He said Mr Hutchings’ record showed four careless riding charges within the last 12 months but he was a leading apprentice who gets a lot of rides. He submitted a suspension of five days was a suitable penalty.
Mr Hutchings reiterated his earlier comments that the incident looked worse due to movement from other runners.
Reasons for Penalty:
The committee took into account all of the submissions. Mr Hutchings was eager to find a way past Mr Riddell as he rounded the bend for home and when he saw a gap open up to the outside of that runner he angled his horse outwards and into the gap. Unfortunately Mr Tinsley was entitled to that run and there was never going to be room for two horses to get through. Mr Tinsley lost ground sharply when he was checked out of the gap. The committee was satisfied the carelessness did fall in the mid-range. Mr Hutchings riding record did not look particularly good with four careless riding charges however he had not incurred any in the previous 5 months which indicated an improvement in his riding. We also took into account his admission of the breach. Balancing all of these factors it was our opinion that a five day suspension was appropriate.
Mr Hutchings advised the committee of riding commitments at Te Aroha on Wednesday April 18th only.
