Facts:
Following the running of race 7, Dunstan Feeds 1600, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr M Cameron, alleged that SHADOW FOX or its rider placed 1st by the Judge interfered with the chances of TRUE ENOUGH placed 2nd by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st - No. 3 SHADOW FOX
2nd - No. 5 TRUE ENOUGH
3rd - No. 4 CAMINO ROCOSO
4th - No. 1 CHARLES ROAD
The official margin between 1st and 2nd was a nose.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
All connections present acknowledged that they understood the Rule.

Mr Cameron identified that at the 150 metre mark his mount TRUE ENOUGH was sitting to the outside of SHADOW FOX. He said that as both runners raced inside the last 100 metres SHADOW FOX commenced a gradual outward shift which resulted in contact at the 50 metre mark. Mr Cameron said the contact occurred at a vital time in the race and he had to stop riding his mount. Mr Cameron said the interference caused a loss of momentum, and he was dictated out by SHADOW FOX from the 100 metres to the winning post. He said after the bump TRUE ENOUGH was “coming back” on the line to be beaten a nose.
Mr Forsman said that inside the 100 metres SHADOW FOX shifted 2-3 horse widths off the rail and made contact with TRUE ENOUGH, who had maintained a straight running line. He said that there were two points of contact, and Mr Cameron couldn’t ride his horse out as a result. Mr Forsman also added that the nose margin was a “significant” factor in relation to the interference that had occurred.
Mrs Thornton said that contact did occur short of the post. She said that TRUE ENOUGH had the full length of the straight to get past SHADOW FOX and her mount's movement outwards was marginal. Mrs Thornton said that she did not deny that contact occurred but she thought that TRUE ENOUGH may have contributed to the interference by moving in.
Mr Gulliver supported Mrs Thornton’s interpretation of the incident.
Mr Coles on behalf of the Stewards said that the official margin was a nose and both parties had raised relevant points. He said that at the 50 metre mark SHADOW FOX had shifted out and made slight contact with TRUE ENOUGH. Mr Coles said that 4-5 strides from the post TRUE ENOUGH then laid in onto SHADOW FOX. He said that the Committee had to determine whether the two points of contact equated to a nose margin.
Reasons for Decision:
The Committee carefully considered all of the submissions and reviewed the video films.
The Committee found that between 100 metre mark and the 50 metre mark SHADOW FOX commenced to shift outwards from adjacent to the running rail to a 3 wide position. The shift by SHADOW FOX resulted in TRUE ENOUGH being dictated off of its rightful running line and SHADOW FOX made contact with TRUE ENOUGH near the 50 metres. The Committee also note that Mr Cameron was unable to ride TRUE ENOUGH out fully over the concluding stages due to SHADOW FOX’s outward shift.
Having considered the degree of interference, the manner in which both horses were finishing the race off and in particular the nose margin at the finish the Committee is of the opinion that TRUE ENOUGH would have finished in advance of SHADOW FOX had such interference not occurred.
