As the breach was admitted we find the charge proved.

Penalty:

Balancing the above matters but with emphasis on the excellent driving record of Mr Dickie and the minor nature of the breach a fine of $200 is imposed.

Charge:

Junior horseman Mr J Dickie drove ONEINATHOUSAND carelessly when he attempted to improve outwards near the 750 metres making contact with the sulky wheel of THE WAIOTAPU WONDER causing his own horse to break.

Facts:

Mr Muirhead showed the video film of the incident. He said Mr Dickie moved ONEINATHOUSAND outwards and the near foreleg of the horse brushed the sulky wheel of THE WAIOTAPU WONDER. ONEINATHOUSAND broke for a few strides and then settled back into its gait.

Mr Dickie and Mr Herlihy accepted the interpretation of Mr Muirhead.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr Muirhead and the acceptance of them by Mr Dickie , the excellent driving record of Mr Dickie, the recommended starting point, the Junior Horseman status of Mr Dickie and accepts the offending is at the lower end of the scale.
