Following race 5 the informant Mr J Oatham alleged that Mr D Oakden, the rider of BIG EINSTEIN in race 5, weighed in 1kg in excess of his weigh out weight.
Submissions for Decision:
Mr Oatham explained that Mr Oakden could not make use of his full claim of 3 kgs. He did however claim 2 kgs weighing out at 62.5 kgs. On weighing in he was found to be 1 kg over that weight at 63.5 kgs. Mr Oatham said Mr Oakden only had light gear and the only explanation for the excess weight could have been a can of drink after weigh out.
Mr Oakden confirmed he had a drink after weighing out but could not really explain the weight discrepancy.

Mr Oatham said this was Mr Oakden's first charge in New Zealand and submitted a fine of $100 - $150 would be appropriate.
Mr Oakden had nothing further to add.

The committee considered all evidence and submissions. In Mr Oakden's favour are his admission of the breach and that this was his first charge in New Zealand. However, as explained to Mr Oakden, the rule is there to protect connections and the betting public and a kg over weight is a disadvantage to any horse.
